Selected Issues Affecting
Workouts and Bankruptcies of
Utilities and Other Highly Regulated Businesses

The panel will discuss selected issues that arise in complex workouts and chapter 11 cases for utilities and highly regulated businesses.  The topics that will be addressed include the remedies available to enforce claims outside of bankruptcy, the impact of the "filed rate doctrine," the interplay between the jurisdiction of the bankruptcy court and other courts and administrative agencies and regulators, chapter 11 plan issues, executory contract issues and financing issues.
