The secondary market for debt and claims before and after the commencement of bankruptcy proceedings has significant impacts on today's chapter 11 practice. Recent cases may have materially impacted certain expectations held by buyers of debt and claims. This panel will discuss recent decisions that addressed the assignability of claims and the legal capacity of assignees to enforce their rights in bankruptcy. The panelists will seek to establish a framework for analysis of standing in the context of claims & debt trading.
