Till Death Do Us Part:
The Impact of the Supreme Court’s
Cramdown Interest Rate Decision on the
Already Rocky Marriage between
Debtors and Secured Creditors in Bankruptcy

In one of the most important bankruptcy decisions in the past decade, with significant implications for both chapters 11 and 13, the Supreme Court endeavored in Till v. SCS Credit Corp. to resolve the proper standard for determining cramdown interest rates for secured creditors under reorganization plans.  While the decision appears to be a victory for debtors, many issues remain, including interpreting a plurality opinion in which no five justices agreed on a single standard, the effect on the feasibility standard for confirming a plan, the manner and type of proof to be used, whether the apparent methodology applies in chapter 11 at all, and how Till is likely to affect the negotiations over consensual treatment in reorganization plans.  The panel will discuss the issues raised by Till from all perspectives:  debtor, creditor, financial advisor and the bench.
